Welcome to Peace Frogs. These Terms of Service ("Terms") apply to your use of www.peacefrogs.com and any purchase you make from us (together, the "Services"). The Services are operated by Peace Frogs ("Peace Frogs," "we," "us" or "our"), 7546 John Clayton Memorial Highway, Gloucester, Virginia 23061. By visiting our site or buying from us, you agree to these Terms. If you do not agree, please do not use the Services.
Our online store is hosted on Shopify, which provides the platform that lets us sell our products to you. You must be at least the age of majority where you live, or have the consent of a parent or guardian, to place an order.
2. Products and Custom Printing
Many Peace Frogs shirts are printed to order in our Gloucester, Virginia shop. Because each item is printed for you, an item may be available to order even when it is not on the shelf, and your order may take longer to ship than a stocked item. We try to show product colors and artwork as accurately as possible, but colors can look different from screen to screen, and tie-dye and garment-dyed items vary by nature — no two are exactly alike.
3. Pricing and Availability
All prices are in U.S. dollars. Prices, products and availability may change at any time without notice. We make every effort to list accurate prices and descriptions. If an item is listed at an incorrect price or with incorrect information because of a typographical or system error, we may cancel or refuse any order for that item, even after it has been placed, and we will refund any amount charged.
Placing an order is an offer to buy. We may accept, limit or cancel any order for any reason, including suspected fraud, quantity limits or errors in pricing or product information. If we cancel an order after you have been charged, we will refund the charge in full.
You agree to provide current, complete and accurate billing and account information, and you authorize us and our payment processors to charge your chosen payment method for your order, including applicable taxes and shipping.
We collect Virginia sales tax on orders delivered to Virginia addresses, at the rate required by law.
Shipping rates, delivery options and processing times are described in our Shipping Policy, which is part of these Terms. Title and risk of loss pass to you when we hand your order to the carrier.
8. Returns — The Peace Frogs Guarantee
We will gladly exchange, credit or refund your purchase any time, for any reason, as described in our Refund Policy, which is part of these Terms.
Wholesale pricing is available only to approved retail accounts. We may approve, decline, change or close any wholesale account at our discretion. Wholesale prices and terms are confidential and may not be shared or published.
If you create an account, you are responsible for keeping your login information secure and for all activity under your account. Please tell us right away if you believe your account has been used without your permission.
11. Intellectual Property
Peace Frogs, the Peace Frogs frog logo, "Live Fun, Do Good," and all artwork, designs, photographs, text and other content on this site are owned by Peace Frogs or its licensors and are protected by trademark, copyright and other laws. You may not copy, reproduce, sell, modify or use any of it for commercial purposes without our prior written permission.
You agree not to use the Services for any unlawful purpose; to interfere with or disrupt the site or its security; to upload viruses or malicious code; to scrape or collect data from the site by automated means; or to impersonate any person or misrepresent your affiliation with anyone.
13. Reviews, Comments and Submissions
If you send us reviews, ideas, comments or other material, you give us permission to use, edit and publish it in any medium without payment to you. You are responsible for anything you submit and agree it will not be unlawful, abusive or infringe anyone's rights.
14. Third-Party Links and Services
Our site may link to or use services provided by third parties, including Shopify, payment processors and shipping carriers. We are not responsible for third-party websites or services, and your use of them is governed by their own terms.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use your information.
16. Disclaimer of Warranties
Except as stated in our Refund Policy, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
17. Limitation of Liability
To the fullest extent permitted by law, Peace Frogs and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services or any product. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
You agree to defend, indemnify and hold harmless Peace Frogs and its owners, employees and agents from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.
19. Governing Law and Disputes
These Terms, and any dispute or claim arising out of or relating to them, the Services or any purchase from us, are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. You agree that any such dispute will be brought only in the state courts located in Gloucester County, Virginia, or the United States District Court for the Eastern District of Virginia, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you may have as a consumer under the laws of the place where you live that cannot be waived by contract.
20. Severability and Entire Agreement
If any part of these Terms is found unenforceable, the rest will remain in full effect. These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, are the entire agreement between you and Peace Frogs about the Services. Our failure to enforce any part of these Terms is not a waiver of it.
21. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continuing to use the Services after a change means you accept the updated Terms.
